By accessing or using the services provided by For Yah Productions, you agree to the following terms and conditions:

General

Booking and Payment Terms

Clients can initiate a booking through our website, email, phone, or during an in-person consultation. A booking is only confirmed once a completed booking form is submitted, the required deposit is paid, and these Terms and Conditions are accepted, either electronically or in writing.

A deposit of 50% of the total service cost is required upon signing the contract/proposal for work and booking to secure the event date and time. This deposit ensures that our team reserves resources, such as equipment and personnel, specifically for your project. All bookings operate on a first-come, first-served basis, and we cannot hold dates without a deposit.

The remaining balance must be paid in full once filming is complete. For custom or expedited projects, payment terms will be outlined in the invoice provided. Accepted payment methods include [e.g., credit card or bank transfer]. Checks will not be accepted. Please note that failure to pay the balance by the due date may result in cancellation of the booking, please see the Refunds and Cancellations Policy section for more information.

Should you need to make changes to your booking, such as adjusting the time, date, or location, requests must be submitted at least 7 days before the scheduled service. These changes are subject to availability and may incur additional fees depending on their scope. For more information on refunds and cancellation, please refer to the Refunds and Cancellation Policy section.

For bookings with in Dallas county travel expenses will be waived. For bookings outside of Dallas county, applicable travel fees will be communicated at the time of booking written in within the proposal.

If the project extends beyond the agreed-upon service duration, overtime charges will apply depending on the scope of the project and size of the crew. We will notify you in advance before additional time is accrued.

We will provide a final confirmation email or phone call before the service date to verify all details, including event timing, location, and any specific requests. Clients are responsible for submitting all necessary details, such as event schedules, required shots, and venue access information, no later than 7 days before the event. Failure to provide these details on time may impact service quality, for which we cannot be held liable.

Usage rights and licensing

Ownership of Copyright

Unless otherwise agreed to in writing, For Yah Productions retains all right, title, and interest, including all copyrights, in and to all original footage, audio recordings, photographs, graphics, project files, editing timelines, raw files, and other materials created in connection with the Services (collectively, the "Works"). Nothing in this Agreement shall be construed as a transfer or assignment of copyright ownership to the Client.

License to Final Deliverables

Upon receipt of full payment, For Yah Productions grants the Client a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, publish, display, distribute, transmit, and publicly perform the final edited videos, photographs, and other deliverables provided under this Agreement (the "Deliverables") for the Client's personal, commercial, promotional, educational, and internal business purposes.

The Client may also:

Edit, trim, crop, resize, reformat, caption, subtitle, dub, add music or voiceover, overlay graphics or logos, and otherwise adapt the Deliverables for different platforms or marketing campaigns.
Extract still images or clips from the Deliverables.
Repurpose the Deliverables for future advertising, social media, websites, presentations, trade shows, email marketing, television, streaming, digital signage, and other promotional or business uses.

The Client may not sell, sublicense, license, assign, or transfer ownership of the Deliverables as standalone creative works, nor claim authorship or copyright ownership of the Works.

Raw Footage and Project Files

Raw footage, camera originals, project files, editing timelines, source files, and other production assets are not included unless expressly stated in this Agreement or purchased separately. Any release of such materials is at the sole discretion of For Yah Productions and may be subject to additional fees and a separate licensing agreement.

Portfolio and Promotional Use

Unless otherwise agreed to in writing before production begins, the Client grants For Yah Productions a perpetual, worldwide, royalty-free license to use the Deliverables and reasonable excerpts of the underlying footage for For Yah Productions portfolio and self-promotional purposes. Such use may include, but is not limited to:

The For Yah Productions website.
Social media platforms.
Demo reels.
Print and digital advertising.
Studio displays.
Award submissions.
Competitions.
Educational presentations.
Industry publications.
Marketing materials.

For Yah Productions may identify the Client by name, business name, event name, logo, and general project description in connection with such promotional use unless the parties have entered into a written confidentiality or non-disclosure agreement.

Client Content and Permissions

The Client represents and warrants that it has obtained, or will obtain, any necessary permissions, licenses, consents, or releases required for individuals, locations, trademarks, copyrighted materials, music, or other third-party content that the Client requests be included in the production, except where For Yah Productions has expressly agreed in writing to obtain such permissions.

Credit

While not required, the Client agrees to make reasonable efforts to credit For Yah Productions when practical and customary, particularly when publishing the Deliverables online or in digital media.

License Effective Upon Payment

The license granted under this Agreement becomes effective only after the Client has paid all invoices in full. Until payment is received, all rights to use the Deliverables remain exclusively with For Yah Productions.

Liability

Confidential Projects

If the Client requires that the Deliverables remain confidential or not be used for portfolio or promotional purposes, such restriction must be agreed to in writing before production begins and may be subject to an additional confidentiality or exclusivity fee.

Client Responsibilities

Clients are responsible for ensuring that all locations, venues, and participants are prepared and accessible for filming on the scheduled date. This includes obtaining any necessary permits, permissions, or clearances required for filming at specific locations.

It is also the client’s responsibility to provide accurate and detailed information about the project, including event schedules, specific shots or moments to capture, and any special requests. If For Yah Productions is unable to fulfill certain requests due to missing or incorrect information, we will not be held liable for any resulting dissatisfaction.

For events requiring specific timelines, clients must adhere to the agreed-upon schedule to ensure the successful completion of the service. Delays caused by the client or their representatives may result in additional charges or reduced service quality.

Limitation of Liability

For Yah Productions is committed to providing the highest quality service and delivering professional-grade results. However, we cannot guarantee perfection in every situation, particularly in circumstances influenced by external factors, such as lighting, weather, or client-provided equipment or venues.

In the unlikely event of dissatisfaction with the final product, liability is limited to the total amount paid for the service. Under no circumstances will For Yah Productions be held responsible for incidental or consequential damages, including but not limited to loss of profits, emotional distress, or reputational harm arising from the use of the videos.

Clients are encouraged to provide feedback during the editing process to ensure the final product meets their expectations. Any issues that arise should be communicated promptly so that reasonable corrections can be made.

Client Content, Permissions, and Releases

The Client represents and warrants that it has obtained, or will obtain, all necessary permissions, licenses, releases, and approvals required for individuals, locations, trademarks, copyrighted materials, music, logos, or other third-party content that the Client requests be included in the production.

Unless otherwise agreed in writing, For Yah Productions is not responsible for obtaining permissions, releases, licenses, or clearances for materials provided or requested by the Client.

Appearance and Likeness Releases

The Client acknowledges that filming may capture the image, likeness, voice, appearance, and performance of individuals present during production.

The Client is responsible for obtaining any necessary permissions, releases, or approvals from individuals appearing in the production unless For Yah Productions has expressly agreed in writing to obtain such permissions.

The Client grants For Yah Productions permission to use Client-provided names, logos, trademarks, and approved project materials solely for the purposes described within this Agreement.

Media Storage and Archiving

For Yah Productions will maintain project files and final deliverables for a reasonable period following completion of services. Unless otherwise agreed in writing, For Yah Productions does not guarantee permanent storage or archival availability of raw footage, source files, project files, or final deliverables.

Clients are responsible for downloading, storing, and maintaining copies of delivered materials after final delivery.

Any request for restoration, re-editing, re-delivery, or recovery of archived materials may be subject to additional fees depending on availability and complexity.

Fullfilment Policy

Fulfillment Policy

At For Yah Productions, we prioritize transparency and efficiency in delivering our services. Below are the key aspects of our fulfillment process:

Service Confirmation

Once your booking is finalized, you will receive a Proposal via email detailing your event's specifics, including the date, time, and location. This ensures clarity and allows for any last-minute questions or adjustments. By signing the Proposal, you confirm that all information provided is accurate and that you agree to the terms outlined therein.

On-Site Filming

Our team arrives prepared and on time for all scheduled filming sessions. To ensure the best results, clients should verify that all participants, locations, and necessary materials are ready when filming begins. Delays caused by unpreparedness may impact the service quality or result in additional charges.

Post-Production Timeline

The post-production process, which includes editing, color grading, sound design, and any agreed-upon special effects, typically takes 2-4 weeks. This time frame may vary based on project complexity. We keep clients informed of progress throughout this stage and address any concerns promptly.

Final Delivery

Final videos are delivered digitally via a secure download link. For packages that include physical copies, such as USB drives or DVDs, shipping will occur within 5 business days after final approval. Clients will receive tracking details for physical shipments. Please ensure the delivery address is accurate, as any re-shipments due to address errors will incur additional fees.

Revisions

Clients are entitled to up to two rounds of revisions at no extra cost to ensure satisfaction with the final product. Revision requests must align with the scope of the original agreement. Additional revision rounds are available for an extra fee based on the complexity of the changes requested.

Expedited Services

If a faster turnaround is required, we offer expedited processing for an additional fee. This must be arranged during the initial booking phase to allow for scheduling adjustments.

Refund and Cancellation Policy

Cancellation and Refund Policy

Client Cancellation

The Client may cancel the project at any time by providing written notice to For Yah Productions. Upon cancellation, For Yah Productions will calculate any refund based on:

the amount of work completed as of the cancellation date;
any non-recoverable third-party expenses reasonably incurred on the Client's behalf; and
the applicable cancellation time-frame outlined below.

Refunds are intended to compensate the Client for services not yet performed while fairly compensating For Yah Productions for completed work and expenses incurred.

Cancellation More Than Thirty (30) Days Before Production

If written cancellation is received more than thirty (30) calendar days before the scheduled production date, the Client is entitled to a full refund of all payments made, provided that substantial pre-production services have not already been completed.

If significant work has already been performed, For Yah Productions may deduct the reasonable value of completed services and any documented non-recoverable expenses before issuing the refund.

Cancellation Fifteen (15) to Thirty (30) Days Before Production

If cancellation occurs between fifteen (15) and thirty (30) calendar days before the scheduled production date, the Client will receive a refund equal to all payments made less:

the reasonable value of services already completed; and
any documented, non-recoverable third-party expenses incurred for the project.

Cancellation Less Than Fifteen (15) Days Before Production

If cancellation occurs fewer than fifteen (15) calendar days before the scheduled production date, the Client will receive a refund only for services not yet performed.

Because production dates are reserved exclusively for the Client and last-minute cancellations frequently prevent For Yah Productions from accepting other work, completed pre-production services, scheduling commitments, and documented project expenses will be deducted before calculating any refund.

Cancellation After Production Has Begun

Once filming has commenced, the Client shall remain responsible for payment of all services completed through the date of cancellation.

If the Client has paid more than the value of services performed and reimbursable expenses incurred, For Yah Productions will refund the remaining balance. If the value of completed services equals or exceeds payments received, no refund shall be owed.

Determination of Work Completed

For purposes of calculating refunds, completed work may include, but is not limited to:

consultations;
creative development;
production planning;
scheduling and coordination;
location scouting;
permit applications;
travel planning;
equipment preparation;
filming;
media backup and management;
editing;
color correction;
audio editing and sound design;
visual effects;
revisions;
project management;
licensing;
administrative services; and
any other professional services reasonably performed in connection with the project.

Refund calculations shall be made in good faith using the reasonable value of services performed.

Emergencies and Force Majeure

Neither party shall be considered in breach of this Agreement for delays or failure to perform resulting from circumstances beyond their reasonable control, including but not limited to:

severe weather;
hurricanes;
floods;
tornadoes;
fires;
pandemics;
public health emergencies;
government orders or restrictions;
acts of terrorism;
civil unrest;
labor disputes;
utility outages;
transportation disruptions;
serious illness;
death in the immediate family; or
other events that make performance commercially impracticable.

When such circumstances occur, For Yah Productions will work in good faith with the Client to determine an appropriate resolution, which may include:

rescheduling the production;
applying payments toward a future production date;
issuing a partial refund based on services completed; or
issuing a full refund when appropriate under the circumstances.

Cancellation by For Yah Productions

If For Yah Productions must cancel due to illness, emergency, equipment failure that cannot reasonably be remedied, force majeure, or other circumstances beyond its reasonable control, the Client shall be entitled to either:

reschedule the project at no additional charge, subject to availability; or
receive a full refund of all amounts paid for services not yet performed.

Non-Recoverable Third-Party Expenses

The Client remains responsible for third-party expenses reasonably incurred on the Client's behalf before cancellation, including but not limited to:

permits;
venue fees;
travel expenses;
lodging;
rental equipment;
subcontractor fees;
licensing fees; and
other project-specific costs that cannot reasonably be recovered.

Copies of receipts or invoices may be provided upon reasonable request.

Refund Processing

Approved refunds will be processed within ten (10) to fourteen (14) business days after the refund amount has been finalized. Processing times may be affected by the Client's financial institution or payment processor.

Good Faith

Both parties agree to act reasonably and in good faith when exercising their rights under this Cancellation and Refund Policy. Refund determinations shall be based upon the work performed, documented expenses incurred, and the circumstances surrounding the cancellation.

Governing Law

These Terms and Conditions are governed by the laws of the United States Federal Government and the state of Texas. By engaging with our services, clients agree to submit to the jurisdiction of the courts in the state of Texas for any disputes or claims arising from this agreement.
