By accessing or using the services provided by For YaH Productions, you agree to the following terms and conditions:
General
Booking and Payment Terms
Clients can initiate a booking through our website, email, phone, or during an in-person consultation. A booking is only confirmed once a completed booking form is submitted, the required deposit is paid, and these Terms and Conditions are accepted, either electronically or in writing.
A non-refundable deposit of 50% of the total service cost is required upon signing the contract/proposal for work and booking to secure the event date and time. This deposit ensures that our team reserves resources, such as equipment and personnel, specifically for your project. All bookings operate on a first-come, first-served basis, and we cannot hold dates without a deposit.
The remaining balance must be paid in full once filming is complete. For custom or expedited projects, payment terms will be outlined in the invoice provided. Accepted payment methods include [e.g., credit card or bank transfer]. Checks will not be accepted. Please note that failure to pay the balance by the due date may result in cancellation of the booking, with the deposit being non-refundable. Any late payments will incur an additional fee of 3% of the outstanding balance per week.
Should you need to make changes to your booking, such as adjusting the time, date, or location, requests must be submitted at least 7 days before the scheduled service. These changes are subject to availability and may incur additional fees depending on their scope. For more information on refunds and cancellation, please refer to the Refunds and Cancellation Policy section.
For bookings with in Dallas county travel expenses will be waived. For bookings outside of Dallas county, applicable travel fees will be communicated at the time of booking written in within the proposal.
If the project extends beyond the agreed-upon service duration, overtime charges will apply depending on the scope of the project and size of the crew. We will notify you in advance before additional time is accrued.
Deposits are non-refundable except in the rare event that For YaH Productions must cancel the service due to unavoidable circumstances, such as illness or irreparable equipment failure. In such cases, clients may opt for a full refund of the deposit or reschedule the service at no additional cost.
We will provide a final confirmation email or phone call before the service date to verify all details, including event timing, location, and any specific requests. Clients are responsible for submitting all necessary details, such as event schedules, required shots, and venue access information, no later than 7 days before the event. Failure to provide these details on time may impact service quality, for which we cannot be held liable.
Usage Rights
For YaH Productions retains the copyright to all video content created unless otherwise agreed upon in writing. Clients are granted a license to use the final product for personal or commercial purposes, depending on the service package and agreement. The license does not permit altering or reselling the content without prior consent. If additional usage rights are required, such as exclusive rights or distribution permissions, these must be negotiated before project delivery and may incur additional fees.
Clients are encouraged to credit For YaH Productions when sharing or publishing videos publicly, especially on social media or websites. This helps showcase the quality of our work while building a collaborative relationship. However, client privacy will always be respected, and we will seek permission before featuring client projects in our portfolio or marketing materials.

Force Majeure
For YaH Productions cannot be held responsible for any delays, interruptions, or cancellations caused by circumstances beyond our control. This includes, but is not limited to, natural disasters, extreme weather conditions, health emergencies, equipment failures, or government-mandated restrictions.
In such cases, every effort will be made to reschedule the service to a mutually agreeable date. If rescheduling is not possible, clients may receive a full refund of any payments made beyond the non-refundable deposit. We are committed to open communication and will notify clients immediately if a force majeure event arises.

Client Responsibilities
Clients are responsible for ensuring that all locations, venues, and participants are prepared and accessible for filming on the scheduled date. This includes obtaining any necessary permits, permissions, or clearances required for filming at specific locations.
It is also the client’s responsibility to provide accurate and detailed information about the project, including event schedules, specific shots or moments to capture, and any special requests. If For YaH Productions is unable to fulfill certain requests due to missing or incorrect information, we will not be held liable for any resulting dissatisfaction.
For events requiring specific timelines, clients must adhere to the agreed-upon schedule to ensure the successful completion of the service. Delays caused by the client or their representatives may result in additional charges or reduced service quality.

Limitation of Liability
For YaH Productions is committed to providing the highest quality service and delivering professional-grade results. However, we cannot guarantee perfection in every situation, particularly in circumstances influenced by external factors, such as lighting, weather, or client-provided equipment or venues.
In the unlikely event of dissatisfaction with the final product, liability is limited to the total amount paid for the service. Under no circumstances will For YaH Productions be held responsible for incidental or consequential damages, including but not limited to loss of profits, emotional distress, or reputational harm arising from the use of the videos.
Clients are encouraged to provide feedback during the editing process to ensure the final product meets their expectations. Any issues that arise should be communicated promptly so that reasonable corrections can be made.

Governing Law
These Terms and Conditions are governed by the laws of the United States Federal Government and the state of Texas. By engaging with our services, clients agree to submit to the jurisdiction of the courts in the state of Texas for any disputes or claims arising from this agreement.
Fulfillment Policy
At For YaH Productions, we prioritize transparency and efficiency in delivering our services. Below are the key aspects of our fulfillment process:

Service Confirmation
Once your booking is finalized, you will receive a Proposal via email detailing your event's specifics, including the date, time, and location. This ensures clarity and allows for any last-minute questions or adjustments. By signing the Proposal, you confirm that all information provided is accurate and that you agree to the terms outlined therein.

On-Site Filming
Our team arrives prepared and on time for all scheduled filming sessions. To ensure the best results, clients should verify that all participants, locations, and necessary materials are ready when filming begins. Delays caused by unpreparedness may impact the service quality or result in additional charges.

Post-Production Timeline
The post-production process, which includes editing, color grading, sound design, and any agreed-upon special effects, typically takes 2-4 weeks. This timeframe may vary based on project complexity. We keep clients informed of progress throughout this stage and address any concerns promptly.

Final Delivery
Final videos are delivered digitally via a secure download link. For packages that include physical copies, such as USB drives or DVDs, shipping will occur within 5 business days after final approval. Clients will receive tracking details for physical shipments. Please ensure the delivery address is accurate, as any reshipments due to address errors will incur additional fees.

Revisions
Clients are entitled to up to two rounds of revisions at no extra cost to ensure satisfaction with the final product. Revision requests must align with the scope of the original agreement. Additional revision rounds are available for an extra fee based on the complexity of the changes requested.

Expedited Services
If a faster turnaround is required, we offer expedited processing for an additional fee. This must be arranged during the initial booking phase to allow for scheduling adjustments.
Refund and Cancellation Policy
We aim to accommodate our clients' needs while maintaining a fair approach to refunds and cancellations. Below are the terms governing cancellations and refunds:

Client-Initiated Cancellations
For cancellations initiated by the client, refund eligibility depends on the timing of the cancellation:

Cancellations made 30 days or more before the service date will receive a full refund, less a 10% administrative fee.

Cancellations made 15-29 days before the service date are eligible for a 50% refund of the total service cost.

Cancellations made less than 15 days before the service date are non-refundable.
For cancellations in the case of an expedited service, a custom cancellation policy will be available with the Proposal.
Business-Initiated Cancellations
In the unlikely event that For YaH Productions must cancel due to unforeseen circumstances such as illness, equipment failure, or emergencies, clients will receive a full refund, including the deposit. Alternatively, clients may opt to reschedule the service at no additional cost.

Refund Processing
Eligible refunds will be processed within 10 business days of confirmation. Refunds are issued using the original payment method. Processing times may vary depending on your financial institution.

Rescheduling Services
Clients may request to reschedule their service date up to 15 days before the originally scheduled date. Rescheduling is subject to availability, and if an alternative date cannot be accommodated, the standard cancellation policy applies. Rescheduling requests made within 15 days of the service date may incur additional charges.

No-Show Policy
If the client fails to show up on the scheduled service date without prior notice, all payments made will be forfeited. To avoid unnecessary losses, clients are encouraged to communicate any changes as early as possible.

In cases where external factors beyond anyone’s control (e.g., natural disasters, extreme weather, government restrictions) prevent the service from proceeding, we will make every effort to reschedule. If rescheduling is not possible, clients will receive a full refund of any payments made beyond the deposit.
